TERMS AND CONDITIONS - NIKI

Please read these terms and conditions carefully. By accessing or using Niki, you agree to be bound by these Terms and Conditions and NECA’s Privacy Policy. If you do not agree, do not use the Niki service.

1. ABOUT NIKI

Niki is a virtual AI assistant service provided by the National Electrical and Communications Association (NECA). It has been developed to support NECA members by delivering summarised knowledge responses through an interactive AI chatbot interface.

Niki is designed to provide general informational assistance only and should not be relied upon as a substitute for professional advice or official publications.

2. ELIGIBILITY AND ACCESS

Niki is available to NECA members with an active Niki subscription, who access the service via authenticated login. NECA reserves the right to revoke or restrict access at any time in cases of misuse, breach of these terms, or changes to membership status.

3. USE OF THE SERVICE

By using Niki, you agree to:

• Use the service only for lawful and authorised purposes;
• Refrain from attempting to extract, copy, or exploit system functionality or outputs for unauthorised commercial purposes;
• Understand and accept the limitations of AI-generated content.

You must not rely solely on Niki for compliance, regulatory, technical, safety, or legal advice.

4. AI-GENERATED CONTENT AND DISCLAIMERS

Niki provides AI-generated content that is based on patterns in data and knowledge sources available to the service at the time of query. While NECA has taken significant steps to minimise the risk of inaccuracies or “hallucinations,” the responses:

• May contain inaccuracies, outdated references, or generalisations;
• Are automatically generated and may not reflect the most current guidance or best practice;
• Should not be treated as complete, authoritative, or fit for any particular purpose.

You are responsible for verifying the information provided, contacting the NECA specialist team at 1300 361 099, or seeking professional advice.

5. PRIVACY AND DATA HANDLING

NECA is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and applicable privacy principles.

By using Niki, you consent to the collection and storage of:

• Your session history, prompts, and interaction feedback;
• Authentication information necessary to verify membership access.

This information may be used for audit, support, quality assurance, and service improvement purposes. Data submitted through Niki is not used to train any external models or systems.

6. LIMITATIONS OF LIABILITY

Niki is an AI-enabled information service and is provided on an “as is” basis. To the extent permitted by law:

• NECA does not warrant that responses will be accurate, error-free, or suitable for any particular use;
• NECA disclaims liability for any loss or damage (direct, indirect, or consequential) arising from your use of, or reliance on, the service or its outputs;

7. INTELLECTUAL PROPERTY

All intellectual property rights in the Niki platform, including design, functionality, and generated outputs (excluding third-party source material), are owned or licensed by NECA.

Users are granted a non-exclusive, revocable licence to use the service for personal or internal business use only. Any unauthorised distribution, commercial use, or derivative use is prohibited.

8. AMENDMENTS

NECA may amend these Terms and Conditions from time to time. Updated terms will be posted online and are effective upon publication. Continued use of the service constitutes acceptance of the updated terms.
